1. Acceptance of Terms

By accessing and using BotaChat, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

BotaChat provides an AI-powered chatbot widget that can be embedded on websites. We reserve the right to modify or discontinue the service at any time.

3. AI Limitations (Disclaimer)

Important: Our services utilize Artificial Intelligence. AI can make mistakes ("hallucinations"). You acknowledge that:

  • BotaChat is not responsible for the accuracy of answers generated by the AI.
  • You are responsible for monitoring your chatbot's conversations.
  • The AI should not be relied upon for medical, legal, or financial advice.

4. Refund Policy

4.1 Free Plan for Testing
BotaChat offers a comprehensive Free Plan that allows users to fully test the functionality of our service indefinitely before deciding to upgrade. We encourage you to use this plan to evaluate the service.

4.2 No Refund Policy
Because a Free Plan is available for testing, BotaChat does NOT offer refunds on any paid subscription plans once a charge has been processed. This policy is strictly enforced and agreed upon at the time of subscription.

5. Subscription & Cancellation

  • 5.1 Cancellation: You may cancel your subscription (Monthly or Yearly) at any time directly through your dashboard.
  • 5.2 Timing: To avoid automatic renewal charges, you must cancel your plan at least 24 hours before your renewal date.
  • 5.3 Access: If you cancel before your subscription expires, you will retain access to paid features until the end of your current billing cycle.
  • 5.4 Downgrade: Upon expiration of the paid term, your account will automatically downgrade to the Free Plan. No data is deleted immediately, but limits of the Free Plan will apply.

6. Account Suspension & Prohibited Conduct

6.1 Compliance: You must adhere to these Terms of Use. Failure to comply may result in temporary limitation or permanent suspension of your account.

6.2 Prohibited Conduct: You agree not to use BotaChat for:

  • Generating illegal, harmful, sexually explicit, or violent content via the AI.
  • Spamming, Phishing, or Mass Mailing.
  • Harassing or threatening individuals.
  • Attempting to reverse engineer the service.

6.3 Procedure: If your account is suspended, please contact our support team for assistance.

7. Limitation of Liability

In no event shall BotaChat or FXINTER LLC be liable for any indirect, incidental, special, or consequential damages arising out of your use of the service.

8. Governing Law

These terms shall be governed by the laws of the United States.
